These Terms of Service (“Terms”) govern your access to and use of choosewildlife.org (the “Site”) and any purchases you make from Choose Wildlife, Inc. (“Choose Wildlife,” “we,” “us,” “our”). The Site and all related features, tools, content, products, and services are collectively the “Services.”
By visiting, browsing, or purchasing through our Services, you agree to these Terms and to our Privacy Policy at https://choosewildlife.org/policies/privacy-policy. If you do not agree, do not use the Services.
1) About Choose Wildlife and the charitable component
Choose Wildlife supports wildlife conservation through grantmaking and related mission activities. We sell wildlife photo prints and related products (the “Products”). Net proceeds (the price you pay minus production and shipping costs) are directed to wildlife conservation grantmaking and related charitable work.
Important tax note: Our Products are priced at fair market value. Because you receive goods of equal value in exchange for your payment, your purchase is not a charitable contribution and is not tax-deductible.
For IRS purposes for print purchases:
- Fair market value (FMV) = the price you pay
- Amount eligible for tax deduction = $0

2) Eligibility and acceptable use
You must be at least the age of majority in your jurisdiction to place an order. You agree to use the Services only for lawful purposes and not to misuse, disrupt, or attempt unauthorized access to the Services or related systems.
3) Access, accounts, and information you provide
To use the Services or place an order, you may be asked to provide information such as your email, payment, billing, and shipping information. You represent that all information you provide is accurate, current, complete, and that you have the right to provide it.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may not transfer or assign your account to another person.
4) Products, limited editions, and availability
We aim to display Products accurately, but colors and appearance may vary by device display and photographic printing processes. Product descriptions, pricing, and availability may change without notice. Some products may be limited edition and may sell out.
We reserve the right to discontinue Products, limit quantities, refuse orders, or restrict sales on a case-by-case basis (including to prevent fraud or abuse).
5) Orders and order acceptance
When you place an order, you are making an offer to purchase. We may accept or decline your order at our discretion (including for suspected fraud, errors, or product availability). An order is considered accepted when we confirm it and/or ship it.
Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted. If we change or cancel an order, we will attempt to notify you using the contact details provided at checkout.
Purchases are intended for personal or household use and not for commercial resale or export.
6) Prices, billing, and promotions
Prices are listed in USD unless stated otherwise and may change without notice. The price charged for a Product is the price shown at checkout at the time the order is placed. Taxes and shipping charges (if applicable) are shown at checkout.
From time to time, we may offer promotions or discount codes subject to additional terms. If promotion terms conflict with these Terms, the promotion terms control.
You agree to provide current, complete, and accurate purchase and payment information and to promptly update it so we can complete your transactions and contact you as needed.
7) Shipping and delivery (United States only)
We currently ship only within the United States. Delivery timelines are estimates and not guaranteed. We are not responsible for delays caused by carriers or events outside our control.
To the extent permitted by law, title and risk of loss pass to you when we transfer the shipment to the carrier.
8) Returns, refunds, and damaged shipments
All sales are final. We do not accept returns or refunds for change of mind.
If your order arrives damaged or has a material defect, we will make it right. Contact us at orders@choosewildlife.org within 7 days of delivery and include:
- Your order number
- A description of the issue
- Clear photos of the Product and packaging
We may offer, at our discretion:
- A replacement print, or
- A refund (and/or shipping reimbursement when appropriate)
We are not responsible for damage after delivery caused by mishandling, improper storage, framing damage, or environmental exposure (e.g., moisture, heat, direct sunlight).
9) Errors, inaccuracies, and omissions
Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions (including relating to product descriptions, pricing, promotions, shipping charges, transit times, and availability). We reserve the right to correct errors and to cancel or refuse orders if information is inaccurate at any time, including after you have submitted an order.
10) Intellectual property
All photographs, logos, designs, text, graphics, and other content on the Services are owned by Choose Wildlife or our licensors and are protected by applicable intellectual property laws.
You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any portion of the Services without our prior written permission.
11) Optional tools and third-party links
The Services may provide access to third-party tools or contain links to third-party websites. We do not control and are not responsible for third-party content, tools, or sites. Your use of any third-party tool or site is at your own risk and subject to that third party’s terms and policies.
12) Feedback and reviews
If you submit reviews, comments, suggestions, or other content (“Feedback”), you grant Choose Wildlife a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display such Feedback in any medium for any lawful purpose, including marketing. You represent that you own or have the necessary rights to submit the Feedback.
13) Prohibited uses
You agree not to use the Services:
- For any unlawful or malicious purpose
- To infringe intellectual property or other rights
- To harass, abuse, defame, threaten, or harm others
- To transmit malware or attempt to interfere with the security or functionality of the Services
- To scrape, spider, crawl, or collect data from the Services without permission
- To submit false or misleading information
- To exploit any portion of the Services for unauthorized commercial purposes
We may suspend, disable, or terminate access to the Services if we believe you have violated these Terms.
14) Relationship with Shopify
The Services are powered by Shopify, which provides the e-commerce platform that allows us to sell Products to you. Purchases made through our store are made directly with Choose Wildlife, not Shopify. To the extent permitted by law, you acknowledge that Shopify is not responsible for any aspect of any sales between you and Choose Wildlife, including any injury, damage, or loss arising from purchased Products.
15) Disclaimer of warranties
To the maximum extent permitted by law, the Services and Products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free.
Some jurisdictions do not allow certain warranty disclaimers, so this section may not fully apply to you.
16) Limitation of liability
To the maximum extent permitted by law, Choose Wildlife will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services or purchase of Products.
Our total liability for any claim related to an order will not exceed the amount you paid for the order giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
17) Indemnification
You agree to indemnify and hold harmless Choose Wildlife and its directors, officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or misuse of the Services.
18) Termination and survival
We may terminate or suspend your access to the Services at any time. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.
19) Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.
20) Waiver; entire agreement
Our failure to enforce any right or provision of these Terms is not a waiver. These Terms and any policies referenced herein constitute the entire agreement between you and Choose Wildlife regarding the Services and supersede any prior agreements or communications.
21) Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms as permitted by law.
22) Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws rules, except where prohibited by law.
23) Changes to these Terms
We may update these Terms by posting changes on the Site. The “Last Updated” date reflects the effective date. Your continued use of the Services after changes means you accept the updated Terms.
